Forum user opinion won't hold in court. You'd need a statement from a manufacturer - which you won't get - or an independent test using calibrated equipment and suitable conditions.

The 0-60 time for a 1.2i is something like 14 seconds, so 0-40 isn't going to be particuarly quick either, maybe 8 seconds if you gut it??

Keep your knickers on Shirley. Just pointing out any court worth their salt won't accept that as legit evidence or for the basis of another argument or point.

Anyway, 0-62 of a 1.2i is 17.5 seconds.

i know this from personal experience, that unless you have an expert witness prepared to stand by what they say about the cars performance, you'll be pulling splinters out of your bottom for weeks....

remember that case where that lad paid to hire millbrook to prove his shonky little jap thing physically couldn't do the speed they reckoned it was.... ok, he got the court to pay his costs, but that is the sort of lengths you need to go to..... they see a lad in a nova walk into court, they already know the outcome, unfortunately.... i hope your solicitor is very good.

Erm you need to back away from the screen a little bit bud as i certainly didnt read that into it, he was just telling you was all!

Take my advice, take everything thats said on here with a pinch of salt, or in some cases a bag of it, as 99.9% is meant in jest or being friendly!

i would say it was less then 8seconds if you gave it the beans, because the reason they do a 60 test is because after about 30-40 mph the forces a car has to deal with is so much more then below those speeds so most cars get to 30 very quickly its just the grunt in others that yank them all the way to something silly, so someone who said 8 seconds just because its roughly half the speed of 60 doesn't mean it will do it in half the time, ever stuck your head out the window at 60. breeeeezey sh1t, and thats all hitting the front of your car! powerful stuff

The NEDC acceleration rates are approx 5m/s/s.... thats set to let the dog slow cars accelerate correctly for the tests.

So just go in with that as no one can prove you accelerated mentally nor that you meandered about

/\ my point about having an independant expert stands.... normal courts don't understand any clever stuff at all.....you go wading in with paper evidence, and they won't accept it.. but if a bloke in a suit says it, then it is all hunky dorey

If it was a pedestrian you hit, you could be in for a hard time as the courts are usually anti-motorist even without public injury lol

Assuming, feel free to correct me if this isn't the case, that the prosecution is trying to blame the injury on excess speed, they probably have medical expertise that backs up the injury-related-to-certain-level-of-speed claim. That would be a hard one to get round too, most courts would take that over any calculation of theoretical speed at whatever distance/time etc.

[edit] Plus, if your car is modified - ANYTHING to engine/weight/wheels/tyres/transmission - it will throw out any book figures from the manufacturer.

I'm surprised the lawyer is that confident tbh, but then we don't have the full details. Let us know how it goes.
