I've literally just joined up too after reading this story. I'm really sorry to read about this loss of a fine motor...

Before you contact VOSA, please check out the MOT status check online for the car to see if it's actually been tested.
If it has, please be aware that the 'person' who was actually testing the car is entitled to take the vehicle for a road test, not someone else.
If it hasn't been tested, or someone else took it out for a road test apart from the tester then you have a good case.

I just joined to say you need to kick right off! Seek legal advice, what they've done is out of order!

Not to sure on the rules of an MOT but I didn't think they had to drive it like!!

Either way name and shame the Garage, they crashed it, should be using there insurance not yours, if it was legit they'd not be ****ting! I got angry as **** just reading this so I made an account to reply!

Gutted for you mate, but on the other hand you've also shot yourself in the foot by having an XE but still a 1300 on the log book....

the last time I tested my 1.3 SR, the tester took it for a road test, I could hear him redlining it, I was furious but kept my mouth shut.

Then after an hour I could hear hammering, I went up and asked, he said that a bit by the front driver's turret looked like it was filler so he had been hammering it with a ahmmer and chisel, removed all the paint etc from under the turret and damaged all the top of the turret. Strangely as the rest of the car was mint it wasn't filler.

That was a few years ago and I have not gone back.

The tester I usually use doesn't road test, I asked him and he says he only road tests if he thinks there may be an issue.

Not much help for you but I hope you get somewhere with this as whoever was driving it shouldn't have been driving it like that, even if there was a clutch issue, whoever was driving should always be wary the first bit of driving in an unknown car, no excuses and end of story.

Any local businesses to the garage that might have. CCTV that might have seen it been driven?

Wether the car is 1.3 or 2.0 or 2.5 or a f***ing 5.8 v8 twin turbo - would you expect it to be smashed up when all you asked for was an MOT test????? As far as my insurance goes its logged and rated as a 2.0 16v with all the other modifications! End of!! The car was left under their control and custody therefore it's their responsibility!! This is why I don't understand why he's being a c**t!! The car was deiven and tested by two different people!! And the funny thing is (well not funny but...) the garage is in the local press today for being in court for damaging someone else's car!!!! F**k me - if only I could turn back time!!!

Ad go straight to police just for his aditude being what it was i.e threatening to nut you?? Deserves every charge possible as obviously has something to hide or why resort to threatening you?

On top of all advice, please makes notes/photographs/video/audio records of anything and everything that happens. Get the garage owner to makes a written statement etc. etc. but most of all GET LEGAL ADVICE. This cahhhnt clearly has something to hide. He WILL pay.

How can it be covered if its not had the right amount of tax paid to use the roads? Doesn't matter if the insurance know its a 2.0 if it's still taxed as a 1.3.

Don't see the point in doing it really to save about £90 a year in tax as the insurance is the expensive one to sort out.

Before everyone jumps on me for this I do feel sorry for the owner and agree this should never have happened whatever the owner has decided to tax/insure the car as. I always wait with my cars at MOT's because of things like this but hindsight is a wonderful thing.

Dont forget to keep a diary of every minute you spend chasing the matter. Every letter you write, every phone call, every visit and every stamp you send.

This is because when you are eventually compensated you will be charging his insurers for your time, expenses and phone bill.

So he is saying he won't compensate you ?

Lee does have a point regarding insurance. Tax evasion is generally frowned on by the law lol If you've just converted though and getting MOT so you can buy tax then fair enough, but its still dodgy ground. Having the wrong info on the V5 is an offence!

Definitely worth going to the police then; they may be able to tie your problems into that case and get you some form of compensation out of it. If not then certainly get in touch with the paper with a 'that happened to me too...' letter.

I think you have misunderstood. You have the incorrect information on your v5. Therefore your insurance company might try and wriggle out. Leaving you in a sticky situation.

VED evasion is a simple civil matter. Naughty V5 is bad though.

Gutted doesn't describe it mate, telling everyone at work about it (MOT station) and no one can believe it. It's a very rare occasion if a car has to be road tested, despite the temptation (lambo's, ferrari's, AMG merc's, Porches...) get in touch with Vosa, speak to the owners of the crane and see if he reported the accident (if not, leaving the scene without contacting the owner is a crime) I know you've lost a car out of this, but I hope it all works in your favour as soon as possible bud

Is the chassis leg repairable or completely smashed up?

It may be possible foor you to gte the car repaired and then chase him for the costs and stress etc. YOu Really need to get legal advice, the only place I can thi nk of free is insurance lawyers or citizens advice, and if you don't like the advice, go back the next day and see someone different. I hada builder who tried to rip me off, first person in CA went alll funny as sson as i produced some of the headed paperwork and told me just to pay uup. My dad went in the next day, saw someone different who said tell the builder to get lost, I did and saved a fortune. So take your time (even though you are fuming) and get lots of careful advice.

Re the V5, get in touch with DVLA now and explain to them you have just hd the car converted and was getting it MOT'd so that as soon as it passed you could then gget it logged as a 2.0. Ask them is this going tt be an issue.

I had an accident a ffew years ago caused by a woman pulling out of a country road in ffront of me, long story short...didn't get no. plate as she took off, insurance would write the car off and send it to reading to dump. After considseration I didn't declare it and took 3 months and some money to get it back. I kept the original bumpers as they have scufffs (battle scars). basically it was a new front panel and wings etc. cost me about 500 i think.

ok, to get your cars details changed at the dvla, so you can tax it correctly, you also need a valid mot.... and a valid mot with the new engine fitted is a positive thing whenn you change the details...

people are trying to pull minor holes in something major here... the person who crashed it will have left fingerprints & dna transfer in this car, the police really should get involved.

the offence of crashing a car during a road test is fairly minor..

the offence of covering up who was driving when it was crashed is massive... and definitely involves prison time.

in what world do you live were you think the police send out forensic teams for issues like this?

Police really wont care unless you can prove it was TWOC'd and I really dont think you can?

Its REALLY unfortunate though, as I would love to see some justice come out of this.

The police don't even bother coming out if you've had your house broken into so I doubt they'll give two fcuks about this, the police force in general are useless imo

Borrow some video recording equipment and a microphone boom and get some mates to pop down making out they are from Watchdog or similar. That ought to get him twitching lol

was talking to my local mot station about this and he said that you need to contact vosa and tell him you are doing so also get on to the local press and the CAB will help you out aswell.

if the owner of the garage is being a c**t about it i'd get the police involved, after all hes drove it with out your permission, by the looks of it hes been giving it a good hammering to cause that much damage and not just taking it into get the mot done, hopefully you get it sorted out and get a new nova

Re needing a valid mot with new engine, yes. But what if the engine has been in for a while and tax fraud has been committed?

then theres no proof

Doubt they can prove how long the engine has been fitted for and if it was taxed incorrectly.

Threatening behavior, TWOC'ing, leaving the scene of an accident, not reporting said accident, total loss claim, you should have enough compensation payout to buy at least three C20TBO's and have change lol.

i came home from holiday to find some low life had removed my nova windscreen...

i played merry fcuk into the police & they sent a scene of crimes tech round to take samples & fingerprints...

this strange world is called leicestershire...

it also helped that i also found the strolen windscreen all of 150 yards from home in someone elses nova& ran a massive one into the case officer

My VX was dusted for prints and had DNA swabs taken from the stereo connectors when i reported it broken into.

unbelievable, when my mazda had the roof slashed and the cd player taken the police said 'what do you want us to do about it' same when my old mans house was robbed!!!

tj, i can be a stubborn bast4rd when i need to be..

eg. my local garage(for work) suddenly stopped us filling 20L jerry cans cos apparently it was illegal..
reason.. some bothering git decided he didn't like mallory park existing & tried to put a stop to where the racing school got their fuel, so he turned up with some paperwork 'proving' that you couldn't sell more than 2 gallons in 2 seperate cans....

so after ringing trading standards & the police licencing unit & then spending 4hrs on the interweb i produced proof that selling as opposed to storing fuel were 2 massively different things, and thus my blokes were able to buy as much fuel as they wanted, but they needed to store it in a safe place when they weren't using it..(they were)

i know it was a long winded response, but basically, get the facts & play merry hell into someone.... it is a simple fact that most coppers & all community support officers are quite ignorant of a lot of even simple laws.

Interesting cause I had some jobsworth give me grief for filling up a 20 litre drum with derv. He said you need a special licence to transport more than 5 litres at a time. I couldn't be bothered to argue as I normally fill up with red fron the yard, we had just run out.

the 1929(or is it 1927?) regs state you can't store more than 2 gallons in 2 1 gallon cans in your own home!!!!!

the PETEL regs state that as long as you have a safe store (fireproof & 6m from a fire source) you can buy as much as you like, as long as you use proper safe cans & not some old plantwash cans etc....
