i just got a court summons through today, for not producing a form i produced in january!! i had a rotton ford escort, possably even more rotton than normal escorts, and i got pulled for my rear arches, went to an MOT place got it stamped, blah blah, produced, goes down to the station today, and they said that theres no record of it!! ive lost the form they gave me back too!! so how many pints or fine, or ban you recon ill get for their ****up, and do i have any rights??

british justice system is f3cking excellant isnt it , have no idea mate about fines , surely you could go to you local test centre and see if they have it on record ? .
I take it you no longer have said Escort? If not, then erm, your pretty shagged. You'll have to go to court and contest it but if plod has no record of this form, then from my experience, they'll deny it all and it'll blow up in your face.
Anyone + Dog vs Plod, the latter will win unless you have water tight evidence to the contrary!
If you do not produce a document it is likely that a summons will be sent alleging both a failure to produce the document and the relevant document offence itself. For example, if you fail to produce your insurance certificate, you can expect a summons alleging failing to produce and driving without insurance. The prosecutor will withdraw the charge of driving without insurance if you can produce your certificate, but the failing to produce charge will stay unless you have can show good reason why you did not produce the document.
Maximum Sentence
This offence can be dealt with only by the Magistrates Court. The maximum penalty is a fine of up to ?1000. The Court has no power to disqualify for this offence or put penalty points on a driver?s licence. The fine tends to reflect the administrative complications that result when documents are not produced in good time
You'll be charged with lacking whatever you were asked to produce - so no MOT, no Insurance, no license - unless you can prove otherwise. In that case you'll be charged with failure to produce, max ?1000 fine.
Drivers license with start date of before offence, MOT certificate which covers date of offence, and valid insurance certificate which covers date of offence should be adequate (I think they can check the insurance database to see if the car was covered). You'll need the receipt to prove you actually did produce the documents though.

went to the police station and showed them, they said i still have to go to court, on a day when im ment to be at work, and present it to the judge!! and the fat ****ing doughnut munchers wonder why so many people hate them?? doesnt take a genious!! (hell, ive worked it out) set to appear before "sunderland magestrates court, on the 11th day of june 2008 at 10am" when im gonna bend the judge over!! let you know what happens, thanks for the help and support lads, especially LUV2XLR8 (http://www.pngclub.com/forum/member.php?u=11570)!!
right, now for the serious bit.....
Work out how much wages you will lose by being at court instead of working, plus the cost of actually travelling there & parking charges... even the cost of refreshments whilst there, & write it out so that you can actually get compensation for being inconvenienced. cos the law always push for court costs.
bare in mind aswell just because your summons is for 10am i can guarentee you wont go in at that time. its safe ti say you will be there for a couple of hours

right, gots ya, ill park in the most expencive place in the town, you cant be charged court costs if your found not guilty can you?? never been found not guilty before!!
They cant charge you if your not guilty, if your not guilty you shouldnt even be there in the first place

what we are saying is that your defence will be 'here is my proof that I did what they asked, your honor, & it has cost me XX pounds to be here, so I want compensating for my outlay because this fiasco was caused by incompetence on behalf of the police.........'
That's actually a god idea mowgli, because they are inconveniencing you. Surely they can discard/delete/cancel a summons if proof is shown instead of wasting the judge's time?

ive been down with the stamped form, they said that because the summons has been sent i have to appear at court!!

the fella who sent my summons is in work on monday, im gonna go and see him, see if i can get it cancelled!!

if a cop cuts you up again, you should memorise their reg no, stop & dial 999 & report it as a dangerous driving incident immediately. did you know that if they have no blue lights on, they have to obey the same rules as us.
