Whats the punishment for no MOT?

Novadex

well if you have no MOT then you have no insurance. so the punishment is unlimited really, if you kill someone... Not worth it at all!

I got pulled over last night at 12:15 and my mot ran out at 12, the copper checked my insurance on the radio check thing and gave me a producer to produce my MOT?

Death most likely.

Hefty fines and points I think

Edit: Now that is unlucky! I think in that situation I would have been completely honest with the copper and tried to get him to let you off.

What about failure to produce?

The copper was **** no chance of any slack

Failure to produce gets your a court summons i think... so you can explain to the nice judge why you didnt produce.

Use, cause or permit a vehicle to be used on a road without a test certificate is an offence under Section 47, RTA 1988.
Penalty: Fine of up to ?2,500 (if the vehicle has 8 or more seats), ?1,000 (otherwise). No disqualification, endorsement or points can be awarded.

Is there just a fixed penalty I can pay or do I have to go to court?

don't you have so many days after it runs out to get another?

i'm probably wrong...

loggyboy

Just get it MoT'd
A copper is unlikely to act on it as it was only a few mins past the deadline, also if it went to court (which i doubt it would) i cant imagine the magistates being very harsh.

Say 1st Feb 06 till midnight on 31st Jan 2007 on the old system, dont know about the computerised ones.

You'll probably just get a ?30 fine or something, in the local paper i've seen people with no license, no insurance, no mot, failing to produce the above get a ?150 fine, LOL.

If MoT places would/could do that no one would ever bother getting one till after they needed it

the only way to get one to cover him for the day he was caught is a 'pub special' lol

Hes just gonna have to get it MoT asap and hope that the copper or his super is feeling generous.

think its about 30 quid fine and 40 quid court costs. a good mate of mine said he forgot what date his mot was and i only found out he'd been done when i read it in the court in breif section of the local paper. haha

depends if you have insurance too. if your not insured, and the car aint got mot, they will take you to court and they focus on the worst which is no insurance and thats 6 points and a fine

Friend of mine got given a producer when he cartwheeled his car through a hedge - only to get home and find the MOT was overdue by a couple days. Got an MOT asap and explained to the desk at the police station when he went in and they were fine about it. So I guess its swings and roundabouts really, 15 minutes over the deadline will hopefully just get you a telling off if you get another MOT asap, and explain how it totally slipped your mind.

As said, no MOT = no insurance so if they want to be really anal about it they could severely screw you.

but arent you allowed to take the car to the test center without an mot.
surely you could blag that you were taking it there? In your case it was late at night but you could say you were dropping it off for an early test?
If you got it M.O.T'd on the day you where pulled then surely it

matt1chelski
01-02-07, 11:34 PM
^^ only works if the mot is pre booked and they check it. But, if i were in the sam situation, just get it mot`d the next day, then u have the old one until say, 31/1/07, and the new one, 01/02/07, so there tech isnt any break.

Prob sound like crap lol

02-02-07, 06:24 PM
i doubt they'll even pick it up mind you did the pull you over because your plate told them you had no tax

mot is

non endorsable fine

or go to court and plead not guilty and the plea will be accepted as its a wasteof court time to persue it

same with loud exhausts

for no insurance i got 6points and ?140 fine as i pled guiilty as soon as the copperpulled me as i knew i had none as id just got back off holiday :(

Jack
02-02-07, 07:06 PM
Loud exhaust is a bit different to not having an MOT, there's no distinct laws against noise levels and those that do exist require very particular dB testing, so very difficult to successfully accuse someone of it. Where as no MOT is a more clear cut "either you do or you don't have one" affair.

If they decide to prosecute or take it further, pleading not guilty would be a bit daft tbh as its clear you did not have an MOT at the time of investigation. So saying you did have one is like, for want of a better analogy, saying you didn't stab someone when you're standing there with the bloodied knife in your hand!

cheshire police are seizing and crushing cars for:- 1.no insurance. 2.no driving licence. 3. no tax disc. 4.If used for crime. 4. Used in an antisocial manner. no mention of mot but I suppose the insurance one would cover that:(

Same happend to me ages ago, didnt realise my mot ran out sooner than i thought and got pulled by the police and given a producer. Also they didnt like the fact that i was driving through the middle of notts with a stanley blade on my passager seat (was my work knife and i worked nights), thought i was going to hurt someone or something.

Anyway when i went to produce my details found out that my mot was out of date and explained, i was then told i was going to severly shafted. But nothing has ever become of it

I take it he got a dodgy mot - either that or the car escaped unharmed when cartwheeling through the hedge

go get mot, do your producer, let the cops know you have had got mot in meantime, tell them it was an oversight and you genuinley did not know, the cops may/may not persue,i had somthing similar,i hate the fuzz, back to the days of my mk 2 escort in the 80s! eat humble pie,?2500 fines are usually the worst case scenario, they are more deterrant. does anyone know of somone fined that??? if goes to court say same thing, was oversight, show you have motd it etc. good luck, let us know the outcome bud!

happend to me my MOT ran out on say monday

i got pulled tuesday at dinner time
(never told him i had no mot just said i wasnt carrying documents)

went straight to a garage got a it mot`d and produced never had a problem..

in your case i think if u take a mot down in the two weeks (or 7 days) not sure how long you have now. you should be ok,

But in the case of a accident novadex is right you insureance does not cover you without a MOT.

but you havent being asked to produce anything else nor had a accident so i would just just take all your documents down anyway allong with a mot and see what happens.

if you end up in court say u """"""just finished""""" a bit of MOT work on the car and you were getting it ready for the garage in the morning. the fine mite be a bit smaller or even get u let off court costs if the judge thinks you were trying your best to be legal.. as for points when your in court the laws the law!

The car was completely totalled (shame, it was kept in absolutely mint condition with some quality choice mods by the previous owner, before said mate got his hands on it). But as I said in the rest of my post...

Got an MOT asap and explained to the desk at the police station when he went in and they were fine about it
i.e. he got the MOT done asap - not dodgy at all, not backdated or anything like that - and just explained to the police he'd forgotten, a genuine mistake, and they were fine with it.
