Its been on sorn since last september but gets started up and moved regularly. Can test it at buyers expense.

Is there a passenger seat included in the sale? Is there a rail for one if not?

No passenger seat included, standard Nova rail is still there so that needs to be cut out and bars welded in if you wanted same seat as drivers side.
