Found this over on mk2cav forum, maybe Admin could make it a sticky somewhere in the For sale section?

Edit*

IT IS NOW ILLEGAL IN THE UK TO SELL A CAR WITHOUT A V5 PUNISHABLE BY A £1000 FINE AND OR INPRISONMENT. THE BUYER MAY ALSO BE FINED

So please all Be aware of this when Buying and Selling your cars.

The Following quotes and links are all from DVLA Website

The law requires both the seller and the buyer of a vehicle to sign a joint declaration on the Registration Document (V5)/Certificate (V5C). The legal responsibility to notify DVLA of the changes rest with the seller of the vehicle (the registered keeper at time of sale). When you purchase a vehicle the seller should tear off the green slip (V5/2 or V5C/2) of the Registration Document/Certificate and hand it to the buyer. The V5/2 or V5C/2 may be used as evidence of keepership when purchasing a vehicle licence up to two months from the date of sale.

Buying a vehicle?
The new keeper of a vehicle must also make a SORN declaration if they do not license and are keeping the vehicle off the road. This can be done on the form V890 mentioned above.

(Taken from Dvla Website) http://www.dvla.gov.uk/vehicles/vehlicnc.htm#i3

7. Unlicensed vehicles and Continuous Registration
If you are/or become the registered keeper of a vehicle, you must ensure that the vehicle is relicensed or a SORN declaration has been made. If it is not, you could face a fine and further penalties. Under the system of Continuous Registration (CR), which commenced in January 2004, it is not necessary for your vehicle to be sighted on the public road, for an offence to have been committed. DVLA now has the authority to carry out enforcement action against the registered keeper directly from information held on the vehicle licence records.

If your licence has just expired you may continue to use your vehicle for up to 14 days after its expiry as long as you have applied for a new licence that must run from the day after the last one expired. This 14-day period of grace is a concession. By law, you must display a current licence at all times the vehicle is in use.

The 306 I had didn't come with a log book, bought it off a mates dad (Darren) and he said he didn't have it but his brother did, saw his brother (Steve) and he said he didn't have it but he definitely gave it to Darren, back to Darren and he said nope Steve never gave me it, off to the DVLA centre in Stockton had to buy a V5 which eventually came, then I got a letter off the DVLA saying the V5 had incorrect details on it which made me think it was stolen (wheeler dealers) eventually the right V5 turned up and that was the end of it, a bit annoying though.

Bought a car that has
no log book
No tax
No sorn
No mot
No registration plates
On Vcar
Registered as scrapped
Registered as stolen
Registered as owned by the insurance company.

I get the logbook in 2 weeks time from the DVLA at a cost of £25
All other paperwork has been delt with by means of phone calls and politely asking.

The original registration mark is being reissued
The log book will be in my name
It is no longer on Vcar
It is no longer registered as stolen
It will be sorned as soon as I receive the V5 using the document number

I will pay no fines or such from previous owners not sorning it
It's all good.

If you do the leg work properly you have no issues but it has taken me 3 months to do it

Everyone one should have a v5 unless it's a mk1 escort where they sold the ID lol

What about salvage then you never get a v5 as they need a vic before you can and the insurance companies destroy them

I applied and got mine, it was scrapped by the insurance company following a total loss claim for theft due to the car being recovered after the insurance company paid out
They have not asked me to go for a vic check either.

To many people rely on second hand information and don't actually try to sort it out.
I found the dvla very helpful actually.

Actually it's more for the seller and you rarely get more than a £60 fine for not notifying them of a change of ownership.

The buyer just has to apply for a V5 and the "could also be fined" is based on not declaring the car sorn, you all know the DVLA are good with words to make thier own lives easier

This has reminded me of my blue SR, I never changed the logbook over to my address and sold the car on without the logbook, completely forgot to dig it out, buyer is a lad I know up the road but he sold it on again and never told me, so I found out who the new owner was and sent him a message on facebook asking if he wanted the logbook and put my phone number in the message.

No reply and again it slipped my mind to sort the log book out until one day I got a letter from Inter-Credit International saying I have been given an £80 fine for not SORN'ing the car, long story short but the DVLA had been sending letters to my old address and when I phoned them up they said it was no longer their concern goodbye, so I phoned inter-credit and they said I had to pay the fine no way out of it etc, was on the dole at the time so went to Citizens Advice and they 'handled' it for me.

So far I haven't heard anything back and I'm not sure if its time to worry yet as there was the potential of a £1000 fine and court summons if the £80 fine wasn't paid, which obviously I haven't paid a penny towards yet and I got the letter about February/March time.

It's not in the hands of the DVLA any more they handed it to these Inter-Credit International people.

Jon_nova1

Inter-credit is the debt collector acting on behalf of the DVLA, the debt is still owned by DVLA unless it was sold to the debt collector

Maybe I was lucky as it was written of but not cat c or d due to being no car to assess? When the police recovered it to the insurance company it would have just been disposed of?
