View Full Version : Where do I stand? Work ultimatum!!
Basically I'm a joiner working for a company who mostly works for the railway be it under Scotrail or network rail. I have worked here for over 10years now and over the mast few years the work has got less and less.
Eventually they dropped our overtime rate to single time for all overtime including nightshift works but overtime is not a part of the job that we must do.
Today I received a text from my manager stating that.....
"2 joiners needed for saturday night @ Dalmeny station, as per Charlie (company owner) - if no volunteers then there will be redundancies on Monday morning"
I didn't reply to the text but I did call every one of the other joiners in the company to see who else had also received this text but it turned out I was the only one to get the text:confused:
Where do I stand and what should I do next?
Can anyone advise me please as I need to see the manager in the morning for my jobs for the day.

Do not delete the text for a start.
Is there a union at work?

it would appear to be a gutless threat. A text for a start is a poor show. There are procedures to follow before making redundancies. If he doesnt get volunteers that means he has more work than he has workers....so how does that mean redundancy?
phone him back and ask what its all about over the phone, it will probably be a different story. It is likely his business is struggling but there is no doubt that some employers have used the recession as an 'excuse' to force workers to do more for less.
The other thing is decide whether you want to do the over time or not. if you want the extra time then do it and dont cut your nose off in spite. If you dont then you can deal with it with him.
keep the text in case you need it in future.
nobody can be forced to do above their agreed shifts. a text like that would look fantastic in a tribunal hearing
you could go & ask the manager about the text, i'm assuming you don't trust him very much.
how about you tell him you got a blank text from him with no message, & ask him what it was about, but make sure you have some other staff with you at the time, then it puts him on the spot, but makes you look innocent
Tell him ill do it cash in hand lol
Nice pay off for 10 years service??? plough it into your garage???
To be honest Davie ive worked for myself too long to no the ins and outs of employment law but i would recon on some sort of payout if they did that.

Can you prove it was only sent to you? Have you had a dispute with your Manager, has he singled you out or victimised you at any point before.
Record everything, time, date and what was said. The more info you gather, the better chance you have if it all gets messy.

Unfortunately there is no union in my work.
The manager in question is as spineless as the come.
I'm not bothered about rocking the boat as I want to sit my class 2 soon as my van sells so I ca start my own recovery business.

Tbh I am one of the lads that gets sent to fix other folks f**k ups.
They usually send me to all the specialised locks etc so I don't see what the problem is or why I've been targeted.

Is there someone above him? or an HR dept? I'd ask for a meeting first thing tomorrow with him, the people above (all of them) and HR monkeys. Show the text and ask f it was sanctioned by all parties in the company and also ask why it only came to you (It matters not that you called the others and found out you were the only one to get it). Really put the twunt under the spotlight.
Also worth stating that is constructive dismissal if they were to off you in that way and it would be a fun jolly in court in your favour. Dont worry about saying it as you can get good value employment solicitors etc to get you out if the turd hits the fan. We did something similar when Carly was given all kinds of stupid ultimatums from an old employer, as soon as they got a letter from a solicitor they started to behave again.
