i bought a car from salvage last year about september. it was a cat d so i applied for the log book. then tried to sorn it online and it wouldnt work so i left it.
i got a letter with a fine in on jan saying i need to pay 40 right now or 80 in a month plus back tax. i wrote to them and phoned them and they are not having any of it and want me to pay it.

the car still is not fixed and laying in work.

question is will they take me to court if i dont pay it

think you are stuffed unfortunately, should have sent a paper SORN, gone to local office (some are more local than others)or rang them, I assume you have a log book now?

Had a similar None SORN online with a tractor, ended up calling at the DVLA office and sorting it.

Suggest you pay the £40 now!

They have now passed my come on to a debt collection agency so I have to pay it even tho it was sorn online, I hate the dvla

I always save the sorn online emails so if anything goes wrong I have proof of the sorn

you could go to court & might win, but to be honest, you really didn't get enough proof to make sure you'll win.

As for your situtation, I'd just pay up. You don't want a court case with the DVLA!

the thing is i never got a reminder or an apply for a tax disk letter. i just asumed cos the car was bought thru salvage that i didn't need to do it.

yes i phoned them today and they were not interested. its funny that my astra van is not on sorn either and never had anything in about it?. that was bought thru salvage and i have the v5 in my name.

6 weeks after i paid the 25 quid for it.

the car is legally your responsibilty from the purchase date.

Yup as John says, if it's in your name you've only 1 way out and that is to take photos proving the car has been kept of road and not in a road worthy state for the time you have owned it, other than that go online, register it sorn and pay the £40 mate,

the fine will still be due though as he hasnt informed the dvla and the fine is for not informing them
