Not guilty...
In brief I was out one night and after nipping in the house to get cash for th taxi I locked myself out! Me and the misses went to sleep in the boot of the passat by folding the rear seats down. About 3hours later a local patrol heard the engine running and decided to try and do me for being it charge with the intention of driving.
Long and short I got off but I'll type up the full events when I'm not using the iPhone.

it is such a crappy rule though, i pal of mine got of for the same thing due to the seats being laid flat there was no intention to drive

I lost mine twice before but to be fare it was deserved as I was fond of making my weekend last 5/6days at the time and thankfully no innocent people crossed my path on the roads....It would have been a shame if you lost it for something as silly as sleeping in your car
The law does state if you're under the influence whilst in charge of a vehicle (i.e. anywhere near it with the keys) in a public place then you can be done, unless you can prove you had no intention of driving said vehicle - as it was parked outside your house then I guess it wasn't too hard to prove!

I know people who have been done for being outsid there house where the car is and having the key in there pocket.
Stupid Law.
Not really stupid, as whilst paragraph 2 states you can get done for being in charge, paragraph 3 then states if you can prove you have no intention of driving said vehicle then you are not "in charge".
In most cases that I could think of, it should be pretty easy to prove you have no intention of driving it.
What a stupid law. If i wanna get absolutely trollied, and decide i want to hear the sweet sound of my 5 cylinder diesel, ill go out and start it. What can you do these days? Its unreal.

ive always been worried about going to get something out my car when ive been drinking since most nights its in a public car park away from my house...
I came close to losing my licence in similar circumstances, the charge is for the intent, i was sat in the passenger side of my mates nova with the keys in the ignition, was arrested and breathalised (after confessing to not being the driver and having consumed between 12 and 15 pints) was taken away and remanded overnight and released on bail to court, ten months later the charge was finally dropped as there is no clear way to prove or indeed disprove an 'intention' and the onus is on the police to prove you had the 'intention' of driving, as much as yours is to disprove it!
Its up to the police to prove you have done something,not you to prove you havent
Your solicitor will ask what grounds/evidence they have for arrest,if its pathetic.They will let them know alright!!!!!!!! lol
