How do I go about claiming against my neighbour for scraping my car and taking my wing mirror off. It's taxed on the drive but not insured, she just drove off and didn't notice. 78 she should have her licence if she can't hear a focus munching the door of a 3 series FFS!

Sorry bud couldnt resist that one, but i wouldve thought their insurance company would try to dismiss the claim as your vehicle is not insured so they will try to wriggle out of it anyway they can!

same as burying your car in someone's wall though it's part of the claim for an accident, you don't need health insurance to claim for personal injury after an accident.

House insurance covers more than just the house. :roll:

So if she'd knocked the fence down what'd happen then? Even if the car didn't have car insurance at the time, it's still someones property that she's damaged.

Aye i knows mate, we had an extension on our home policy to cover mobile phones, my dads camcorder and my mountain bikes when i was younger.


I mean you will probably find the insurance co wont want to know as the lads car isnt insured, purely because they dont like having to part with their riches do they, fingers crossed it gets sorted but be prepared for a fight over it i would say!

I would've thought you'd have to go through small claims court? That's what a mate of mine had to do when claiming off an uninsured driver so can't see why this would be different?

True, but not sure about car stuff. Well, none of my stuff got replaced when my parents garage went up. With my car, parts, tools etc all inside :cry:

my house went up in flames a few years ago and i lost 2 bucket seats, they said because they were car related (or something along them lines) they wont replace them, but on the plus side i got my PS2 replaced with an x-box 360:d

The driver is insured, so should be covered. The car that was hit isn't insured

I'm assuming your car was not on the road at the time of the accident. Otherwise you're knackered!

[edit] Oh yeah it was on the drive. Doesn't matter if your car is uninsured, she hit you so she's claiming on her insurance to cover the cost of repair.

cheers guys. I shall be phoning her insurance today. She's trying to wriggle out of it I can't beleive it. My 78yo bible bashing supposibly nice neighbour who I've lived next to for 10 years has tried everything to blame me.

Is there a legal implication that she we think she noticed and still drove off? The bloke over the road heard the crunch, came out to check his car saw that it was fine, she stopped for a second and then drove off. He didn't notice my car

afaik leaving the scene of an accident is only an offence if there are persons injured.

I rang my insurance company who are also her company. Their advice was to either make sure she puts in the claim or get a solicitor. He said my car was legal to be where it was.

Call an accident management company... as much as I hate them (in terms of what VX and Elise owners screw out of them), they do get the job done.

I;ve spoken to her and she's going to ring her insurance but is still arguing that it's my fault for the position of the car when it's clearly not on her property. She said "With my Disability I can't look around" errrrm wing mirrors are for looking into not for beemer bashing and if she can't do that then she shouldn't be driving.

She was parked further forward as she has slabs on the grass, she backed out on the piss and scraped it. She said the slabs help her go straight FFS she needs her licence taking away.

I will go greener then her car and tear stuff if she doesn't ring them tomorrow

Fcuk all, as the accident occurred at the time she WAS insured... so you'd continue with the claim on her insurance.

ok kinda aggree with the spoiler the wheels are not bad better with shnitzers and do you have any interior photos and clean the ash trays out but you wont get the smell away if you dont stop smoking it in your car lol

Why do people always think this, only your own insurance company (through your own policy) can write off your car, even if she is insured with the same company as you, it is only your own policy that can write it off, youre not claiming from your own, you are claiming from hers, so all that will happen is you will get a 'total loss settlement' meaning they will pay out what they would pay out if it were a total loss, or write off, but as its not your policy then they have no power to write it off, trust me i had the same thing with my old red nova and got a total loss settlement of about £300 minus admins fees and such, i think i got about £220 and my car was not written off as the other parties company/policy cannot do this!

Total loss settlement you plum, unless they are the actual insurers providing the actual policy on the car in question (i.e. if it were insured and he was claiming from his own policy) then they cannot write it off as they dont own the cover on the car!

You shouldve gotten total loss settlement on it anyways, and obviously you wouldve kept the car anyways as you claimed from the other party did you not?

i phoned there insurance, some bloke come out, looked at it, walked away, next day a phone call telling me total loss and agreed a fig, with me keeping the car, 3 days later i had the money in my bank lol

After selling my Corsa and pocketing this cash I think I'll be able to pay off all or maybe 80% of the years insurance... awesome
