View Full Version : Insurance claim on uninsured car
How do I go about claiming against my neighbour for scraping my car and taking my wing mirror off. It's taxed on the drive but not insured, she just drove off and didn't notice. 78 she should have her licence if she can't hear a focus munching the door of a 3 series FFS!

just go to her door and say she hit it and she has to pay for the damage.
I've gone away, my mum is dealing with it she just gave my mum her insurance details after she collared her
Couldn't it go through the house insurance?
Couldn't it go through the house insurance?
I wouldnt have thought so as it was her car that hit his BMW and not her house lol
Sorry bud couldnt resist that one, but i wouldve thought their insurance company would try to dismiss the claim as your vehicle is not insured so they will try to wriggle out of it anyway they can!

same as burying your car in someone's wall though it's part of the claim for an accident, you don't need health insurance to claim for personal injury after an accident.

House insurance covers more than just the house.
So if she'd knocked the fence down what'd happen then? Even if the car didn't have car insurance at the time, it's still someones property that she's damaged.
Aye i knows mate, we had an extension on our home policy to cover mobile phones, my dads camcorder and my mountain bikes when i was younger.
I mean you will probably find the insurance co wont want to know as the lads car isnt insured, purely because they dont like having to part with their riches do they, fingers crossed it gets sorted but be prepared for a fight over it i would say!
I would've thought you'd have to go through small claims court? That's what a mate of mine had to do when claiming off an uninsured driver so can't see why this would be different?
But as said, be prepared for a long battle.

True, but not sure about car stuff. Well, none of my stuff got replaced when my parents garage went up. With my car, parts, tools etc all inside

my house went up in flames a few years ago and i lost 2 bucket seats, they said because they were car related (or something along them lines) they wont replace them, but on the plus side i got my PS2 replaced with an x-box 360:d

The driver is insured, so should be covered. The car that was hit isn't insured
just go and insure your car now

Yeah, I can read :p as spud says doubt her insurance will pay out.
I'm assuming your car was not on the road at the time of the accident. Otherwise you're knackered!
[edit] Oh yeah it was on the drive. Doesn't matter if your car is uninsured, she hit you so she's claiming on her insurance to cover the cost of repair.
cheers guys. I shall be phoning her insurance today. She's trying to wriggle out of it I can't beleive it. My 78yo bible bashing supposibly nice neighbour who I've lived next to for 10 years has tried everything to blame me.
Is there a legal implication that she we think she noticed and still drove off? The bloke over the road heard the crunch, came out to check his car saw that it was fine, she stopped for a second and then drove off. He didn't notice my car
afaik leaving the scene of an accident is only an offence if there are persons injured.
I rang my insurance company who are also her company. Their advice was to either make sure she puts in the claim or get a solicitor. He said my car was legal to be where it was.

I thought your car was uninsured?
I thought your car was uninsured?
My shell is uninsured but I still have an insurance company :p
Call an accident management company... as much as I hate them (in terms of what VX and Elise owners screw out of them), they do get the job done.
Europa and the likes
The Insurance company for my Corsa
I;ve spoken to her and she's going to ring her insurance but is still arguing that it's my fault for the position of the car when it's clearly not on her property. She said "With my Disability I can't look around" errrrm wing mirrors are for looking into not for beemer bashing and if she can't do that then she shouldn't be driving.
I missed the damage on her wing mirror

You also want to take photos of the locations of both cars as they are/were when the incident occurred!

you do know they will write the bmw off lol
They better not do haha
She was parked further forward as she has slabs on the grass, she backed out on the piss and scraped it. She said the slabs help her go straight FFS she needs her licence taking away.
I will go greener then her car and tear stuff if she doesn't ring them tomorrow

No certainly not a tight fit if you reverse straight or check mirrors
i recon you should take it further than the insurance and try get her to have a re sit.. what would happen if she canceled her insurance now just out of curiosity
I'd take her to small claims court and rape her blue rinse!

go tell her,
i prayed to god last night, he told me you will do the right and legal thing lol
I think she will as she didn't like the idea of me getting a solicitor. I mentioned that's what Swintons said
she knows if a solicitor takes her to court her license will be in jepready <sorry for spelling errors

Fcuk all, as the accident occurred at the time she WAS insured... so you'd continue with the claim on her insurance.
ok so her insurance company would still pay out becouse it happend when she did have insurace cant beleave you havent even had it on the roasd and its been crashed in to already i would of cried lol
I've found a door, £50 with £11 p+p and could charge her that and swap everything over if I was being nice

If you were being really nice you could just leave a steaming poo on her car bonnet.
tell her its 230 for a door and 30 for a wing mirror but remember thier will be a garage labour charge as well so looking at bout 300 or more is she dont want to go threw the insurance
(off topic, how long have you had a bimmer!)
Couple of weeks can't believe she did this to the 2nd car I've ever been proud to own... well after I dechav it somewhat

Haha double decker ironing board and a few interior bits. The wheels are debatable
And it stinks of weed inside!
ok kinda aggree with the spoiler the wheels are not bad better with shnitzers and do you have any interior photos and clean the ash trays out but you wont get the smell away if you dont stop smoking it in your car lol
I still need to give it a really good clean. might do it this weekend.
It has a gay sparkly gear knob, more like a but plug. I'm sure they'll write it off for that alone

Its always a hard one to call.
With her being old, the police may take her side.
All she has to say, is he wasnt parked there he was right over:wtf:
Some young lad in an m3 replica, vs an 80yr old woman.
She will win lol
No she wont as even if I was slightly over she has proven herself to physically be unfit to drive
he hasent moved the car since he has got it due to no nsurance they have no reason not to beleav you do you have a nova as well as the bm ?
Not any more no. Corsa and BMW
supos a corsa dosent look quite as bad as a nova when the police come round

cretin.
If it happened on private land, then its a civil matter, the police wont care.
Call an accident management company and get them on the case.... Seriously, do that!!!! otherwise you will be pissing about in pointless circles of "ohh will she , wont she"
She has till the end of the week 'till I go with that Stuart
i supose if you do as stuart says the matter will be getting delt with proffesionaly and you no at the end of the day it will be getting done insted of being mucked about
Dont fanny about, shes not going to come up with anything.
The longer you leave it the less she will remember and simply make up (or obtain a better story from her offspring/grankids etc)
i supose if you do as stuart says the matter will be getting delt with proffesionaly and you no at the end of the day it will be getting done insted of being mucked about
Last warning about text typing, do it again and you get a permanent holiday unlike the few days last time ;)
This is true. If she doesn't tomorrow then I will, Can;t be much fairer to her then that. I think she's got a touch of Alzheimer's so will probs forget
Last warning about text typing, do it again and you get a permanent holiday unlike the few days last time ;) ? if it is about my spelling then am sorry but i do check my post before posting them ?

"and you no at the end of the day "
no = shortened know.... = text typing = FINAL WARNING. Deal with it.
She's done the right thing and gone into the local Swinton's branch and the paper work is going through. I don't know what happens next though
you do know they will write the bmw off lol
Why do people always think this, only your own insurance company (through your own policy) can write off your car, even if she is insured with the same company as you, it is only your own policy that can write it off, youre not claiming from your own, you are claiming from hers, so all that will happen is you will get a 'total loss settlement' meaning they will pay out what they would pay out if it were a total loss, or write off, but as its not your policy then they have no power to write it off, trust me i had the same thing with my old red nova and got a total loss settlement of about £300 minus admins fees and such, i think i got about £220 and my car was not written off as the other parties company/policy cannot do this!
That's good to hear Spud. I think Baxter was joking though lol
Ahh furry muff, its just a lot of people actually think they have the power to write it off, this is not true so dont worry youre not goona lose your car bud:thumb:

total loss = written off then lol
total loss = written off then lol
Total loss settlement you plum, unless they are the actual insurers providing the actual policy on the car in question (i.e. if it were insured and he was claiming from his own policy) then they cannot write it off as they dont own the cover on the car!
Man wheres Ollie from Sky when you need him lol
Haha. If they want to give me in cash what it's worth then they can take it lol
I'd go get a 320 and save myself a shed load on insurance

even they they classed it as a total loss

You shouldve gotten total loss settlement on it anyways, and obviously you wouldve kept the car anyways as you claimed from the other party did you not?
