View Full Version : Ebay, seller says he sold my engine!

Hi Guys,

Long time since i have been on due to me being in malaysia but need some advice on this so hopefully you can help me out.

Some of you might have seen the brand new c20xe engine on ebay for 975 for sale that finished last night, well i was the winning bidder. it is to be rebuilt and to go in a Chevrolet WTCC car to compete in the asian touring car series and so would make an excellent base for us to start work on.

Anyways after winning it the guy mailed me and said:

"sorry mate not letting it go for that price, call me on 078******** if you want to discuss a price,
thanks"

and then he sent:

"sorry mate its been sold now anyway, thanks"

What do i do know? i really need this engine to have it built up in time for us to go to Korea, i have all the parts sat he waiting to go in, just need thsi engine!! Ebay wont let me raise a case until the 15th July and i need to have paid but theres no point in me sending money now is there?

Where do i go from here, anyone experience this before?

an ebay auction is a legaly binding agreement when sold he cant just say your not having it for that, you could get a solicitor involved but would take time to sort and you need the engine now, just because its an internet auction dosent change anything the same laws apply as with other auctions, just like if you buy something on ebay your legaly bound to pay for it or the seller could legaly sue for breach of contract, unless the item isnt as described

he has breached his contract with you by not selling at the agreed sale price with no reserve he has no leg to stand on

what a nob why put the starting bid below a price your willing to sell at i always list with a start price im willing to let it go for if it goes for more bonus

that looks rather a lot like the one LMF gave away at PV? lol Always thought it was a bit of a duff prize, buy a brand new turbo for a Z20LEH/LET and get an entry into a competition to win a 20 year old NA engine lol

lagaly hes breached contract you can sue him, a solicitors letter making him aware of this might make him think again

i had this a few months ago, won a complete xe and box for £250,

then he comes across and says sorry not letting it go for that much, i wanted atleast £300

i reported him to ebay,


you are in a binding contract, he HAS to sell it to you at that price

why dont you go round there with the cash and say look i won it you have too sell it too me then just take it and leave the money on the side

Yeah because he'll definitely let you in and not interfere while you put an engine in your pocket and walk out lol

the pressent chevey cruize and the previous lacetti in both wtcc and btcc use an xe there still used in canada i think its canada anyway so they can geat round the rules and use them shows what a good engine they are imo

the engine is used in the chevrolet astra gsi in argentina the btcc rules state that if the model dosent come with a 2.0 from the factory you can use a 2.0 from the same manufacturer hence there legal to use it its also how team dynamics can enter a 5dr civic and use the type r engine as the car needs to have 4 passanger doors to meet s2000 regs paul oniels car runs the older rules (integra) just checked a thread on btcc forum about it

power wise i would presume its similar to the swindon output befor the reverse head

will look like a let next year when the rules change to the ngtc engine they will then either be able to hire or buy a standard btcc spec engine (like andrew jordan is running this year) or build there own from a model specific or manufacture same engine or 2.0 or bored and stoked to reach 2.0 btcc will then supply the turbo ecu injectors and intercooler aim is to reduce costs and even the field giving all cars around 300bhp the actual btcc ngtc engine has been designed and built by swindon too

in that case in be sending a solicitors letter by courier so he has it tomorrow, (my dads mates a slicitor so can get things that quick from him) would shock the **** out the seller lol

do you reckon they still used leaded fuel over there? or is it that corn liquor stuff?

do it, just a case of didnt make what he wanted, he's legally bound to sell you that engine, it is a formal contract despite it only being ebay, both parties are legally bound to complete the transaction, other than as said before if the item is not as described or both parties mutually agree to not complete the sale

agree to come & look at it. then decide. i think it is overpriced. especially if they still make the engine somewhere in the world.

afaik it's not a brand new engine anyway, been rebuilt with all new gaskets, which might not even be genuine parts.

Its the one LMF had on their stand at PV, which they conveniantly never said was new and kept harping on about all new gaskets etc, might just be clean lol

You would be better off getting a XE cheap and rebuilding it yourself at least you'll know what's been done to it,

I know that's not much help with a short timescale tho.

i've had a guy try to do the same, he put an auction up for a c20xe air flow meter, i won it for 6.50 and he sent an email saying its worth more than that and he paid 35 quid for it, he said he wanted to relist it so i sent him the money so he cant lol he sent me another email saying he will post it when he gets chance and i've got a bargain as its worth more than 6.50 lol i know that pmsl

if i were you, i'd phone the guy and tell him to read ebays rules about a legally binding contract, tbh, hes being greedy, most people with that kind of money would buy a let! i think because he knows you need it, hes taking the p!ss. ebay do have a phone number now dont they?? might be worth ringing them??

Yeah Claire, Ebay have a number now, Answered me within a minute and were very helpful, though in this case, theres no t alot they can do, though it might be worth getting their advice

It's was auto Vaux who gave away the engine at pv, give them an ring and they will sell you one for 1200 :)

I wanted an unstressed block with low or no miles to rebuild, after this amount of time the stress' should have left all the components i want to use so it would make it ideal as you hardly see a c20xe with less than 100,000 on it now.

I sold a X14XE last night for £225, where as sold a full Safety device's Nova cage for £125 8 months ago.

Hassle him with legal mumbo jumbo and watch him fold under pressure. Soon as I read your post mate (boffer) it was obvious he didn't sell it. He was probably waiting for the 'well how much will you take for it?'

At the end of the day, no reserve, it's easy to see that the engine is as described and you have more than 5 feedback and meet his criteria. If eBay let this slide then what's stopping people doing the same with other items.

I'd call eBay up, have a word, get them to get in touch or get their advise and send out a legal letter.

I though you couldn't get brand new engines from Vaux. I do know you can get reconditioned engines from them with an 80k warranty IIRC. They are normally around the £1200 - £1400 price range (I asked vaux a few years back).
