Hi all need some advice,

In April I was in standing traffic heading for work, as traffic set off the girl infront of me braked hard and I rolled into the back of her it was so slow it did no damage to my Nova and just put a small crack in her back bumper, we exchanged details and agreed that I would have the car repaired for her and not involve insurance as the damage so so minimal, I priced it up new from Ford the back bumper was just the middle panel (£30) and a rear number plate light (£10) she agreed to let me do the work so I booked an appointment at a friends body shop.

I then rang the girl to say appointment is booked, her dad answered the phone and said she wants to go through the insurance as she has whiplash, this is impossible as I didnt even hit her hard enough to move her car forward (he admits this and says that is because she had her handbrake on). So basically I am being scammed for this and when I spoke to my insurance they said did you hit her from behind I said yes and they said its my fault then cant really contest it.

So my insurace for a Nova x16xe all registered was £1100 last year and when this has gone through my renewal will be £2450 :wtf:, so this £50 repair is going to cost me £1300 plus £250 excess, can anyone think of a way on contesting this, or I might just pay the insurance direct for the claim???

Any ideas??

The chance of money with a wiplash claim, pathetic. The reason if you ever get hit, you got wiplash too!

Insurance is never going to get cheaper. No advice really, although if she slammed on her brakes that quick how can she of had the handbrake on?

Dodgy Biatch!!!!! and doctor for that matter if whiplash has been confirmed. If no doctor is involved you could contest it as she is claiming for something that is unproven, otherwise I am afraid you have no chance.

I am currently investigating someone we insure who seems to make a living out of whiplash claims (very similar circumstances to your accident and many many claims over a 5 year period) and it looks like the doctor may be getting money from the settlements too.

You will have to take the hit on this one unless you can prove the girl is lieing as you shunted her (regardless of how hard) sorry mate.

was going to edit my post but though this might be quite important so seperate post it is.

Was having a think about the claim and you could contest it as the damage done shows that it wasn't a high speed bump and that whiplash is not likely to be a result of such a low impact, low speed crash. Not sure how much it would help but if you think along these lines you may be able to build a case against her.

Possibly ask your insurance to dig a bit deeper as you don't believe a word of it (they may find she is a serial claimer) and so on.

Spoke to my mate who is a solicitor she says ring my insurance on Monday and kick off state very clearly under 5 mph and no forward movement and ask them to contest it.

I accept I will have to stomach this one but on morals I dont want her to be able to claim whiplash, plus if its just damage might be able to pay the full cost of the repairs and in effect not have a claim on my record.

I am even considering ringing her and offering a £1500 cheque to cancel her claim would be cheaper in the long run but I cant stand the idea.

She was quite fit but a bit chunky (I have seen her putting makeup on in the car in traffic before this incident :roll:). its all I can do to stop myself going to her house and kicking her full pelt in the taco when she answers the door.lol
