two months ago a guy joined our work force of painters at first he was top guy and very handy at his job as the weeks went on he started becoming sly and quick to get out of conversation and things like that. he has been on our work insurance for a month then this morning he wrote one of our vans off into a cement mixer getting himself in a right mess and air lifted to carlisle hospital. luckily the other lad in their was ok just bruised.

so its about dinner time today my boss gets a call confirming the crash by the police. they also confirmed he had no licence and was over the limit! AT WORK! so now my bosses insurance is void all 3 partys are claiming in the crash and also the cements companys suing for loss of earning.

anyway point im getting to is we might be loosing our jobs because of some muppet who didnt have a licence

make his life hell. What an idiot! However my blame is also with your boss surely he would of asked to provide his driving licence for insurance purposes? My boss did when i 1st started on my appretice. (sp)

Irrelevant if he was over the limit too, license or not insurance is still invalid surely?

it all depends on whether or not he made a false declaration to your boss.

if he did, then your boss is in the clear...if he didn't, them your boss is screwed.

we have a file at work with copies of all the drivers licences.

ye our fleet insurance covvers anyone over 21. but jus for keeps he ask for copys of card and paper part. what this lad has done is just given the paper so we thinking it aint even his. its just **** all over everyone

am talking about when he 1st started the job etc proof of driving license etc then they keep a photo copy of it :thumb:

we have a file with all our licences in as well...even though i cant drive the work lorry (too young) they still had a copy.

i would have thought your boss would have wanted a copy of it so he could put him on the insurance.

well tbh when someone hands u a counterpart you expect them to be genuine. also the references this guy hand from 3 past employers and also dulux select decorators was quite impressive. hit my boss hard not expected at all

so if the worker has given fraudulent information to get the job, then all liability should be aimed at him, as if your boss has a copy of a driving licence in his possession, then he has made a decent effort to keep things legal.

Could have lost his licence just after joining, your boss should have taken a copy to send off to the insurance company, they should have asked for it! In reference to the over the limit at work he is at fault therefore the insurance company will take him to court for costs, your boss will also have to defend the case from the cement company because at the end of the day his employee has made false decelerations and been drinking at work, not something your boss will condone im sure!!

Your companies liability insurance should cover it, and the excesses paid would have to come from the the chump that decided drinking at work & driving all without a full licence.

Failing that or your boss will have to wait for him to recover then sue the crap out of him for everything he has!!

Shouldnt your boss have checked he had a license before insuring him and letting him drive company vehicles?? Or have i missed something?

my boss had copys of both and he wanted to see them in person
as for the n**head that was drink driving they should through the book at him imo

I've always had to give my employer a copy of my driving license (photocard and paper part). I think your boss will have a hard time explaining why he never asked for such.

Not good though, especially if it threatens your job.

read the above mate he gave a paper part but it is apparently not his! as for the insurance it is fleet insurance for anyone over 21 my boss asks for licence to protect his ass

your boss had better get the old bill involved if they aren't already, and make a statement alleging fraud. he should get legal assistance from his insurers cos he did, in good faith take a licence from him.

it will be a royal mess, but he should chase the bloke for any costs he incurs over this.
