Thats complete rubbish, if that was the case every auction house in the UK would be commiting this crime everyday as around 20% of cars through auctions dont come with a V5, Every CAT C car is sold without a V5 as well.

Its an inconvience but if you get a signed letter from the supposed owner and make a note of address etc i have no worries about buying car without V5's.

On the Vosa or DVLA website it clearly states it is an criminal offenceto SELL a car without the V5.

In my humble oppinion, how can you check that the chassis numbers and engine numbers match the documents and that the seller is who he says he is, without V5 and some form of identification. Madness. The car will be stolen !!

It is somewhere on the DVLA or VOSA website. Honest

Apply by post

You’ll need to:

complete a V62 ‘Application for a Vehicle Registration Certificate (V5C)’ available for download, or from any Post Office® branch, or from a Driver and Vehicle Licensing Agency (DVLA) local office
enclose the £25 fee
send your completed application to DVLA, Swansea, SA99 1DDIf your name, address or both have changed, you can notify DVLA on the V62 form at the same time.

Its not illegal or criminal to buy a car without a v5! Otherwise as stated above the auction houses that sell finance repossessions etc would be in court weekly or daily! And a quick trawl of ebay would result in a few hundred people in court!

Its not advisable though, although there are often genuine reasons for losing a V5 - I bought an Astra estate without one as the seller had moved house and lost it. It hpi'd clear, had loads of other history and I got a new one from dvla within a couple of weeks...

If it was illlegal or criminal then the dvla would not permit a new owner to apply for a v5!

Nowadays there are many more accurate ways to check a vehicle is legitimate - HPI to name one. A v5 is not proof of ownership as it states on the older style V5s - it actually just shows the person or company responsible for ther vehicle. For example our leased vehicles at work are in our name on the v5 but we do not own them. Same for a car on finance for an individual.

If you buy a used vehicle - seller does not have a registration document or certificate

If the seller does not have a V5 registration document or V5C registration certificate, you should register the vehicle in your name by using form V62 'application for a registration certificate'. You can get one by download from the vehicle forms link below or from any Post Office® branch or a DVLA local office. DVLA will then send you a new registration certificate in your name.

Source (http://www.direct.gov.uk/en/Motoring/BuyingAndSellingAVehicle/RegisteringAVehicle/DG_4022310)

However, the DirectGov website also states:

You must notify the Driver and Vehicle Licensing Agency (DVLA) immediately of the exact date of sale or transfer of your vehicle using the registration document or certificate. You and the buyer should follow the procedures correctly or you will remain liable for the vehicle until DVLA records have been updated.
So it does kinda contradict itself lol
