Today a freind was clamped by the DVLA they are insisting he pays for its release the car is on privatley owned land to which the owners have not given consent for the DVLA to clamp untaxed vehicles. The vehicle is SORN and Immobolised. Do we let them take the car and safe store it, whilst sueing their butts
or remove clamp and move car or just chain the car to another vehicle, their for preventing them taking it and write to them, as telephone conversations has resulted in DVLA hanging up.

if the car was driven there on the road un taxed then what do you expect !!!

remove the clamp off without damageing it ( wheel off, undo bottom arm) then hand it in to the police as found property then move vehicle quickly, ive done it before

move to Scotland cos it's illegal to clamp cars up here, under scots law it's classed as extorsion, mind you they just lift the car and pound it.

just remove it as said in previous post, two police officers told me to do it when my brothers car got clamped, just don't damage it

does he have consent from the owner of the land????? if so, then get the rozzers involved. you can choose from extortion, criminal damage, trespass, and a few others at a guess

f##k it cut it off me and my mate did when he had his 306 cab clamped though he did have not tax and it was on the grass outside his

we moved the car after we atacked the clamp with the stihl ts400
lol at dvla nothing ever came back but we must be lucky though its your decision as what to do

How can it be illegal?

If someone put handcuffs on you for no reason you would cut them off?

So why not cut it off your car?

Unbolt the entire strut, hub & wheel assembly with the clamp attached.

Get said parts from scrap yards, refit scrap yard parts to your car an drive away.

Leave clamp complete with hub & wheel assembly in the car park.

Dont chain it to another vehicle as theyll take that aswell.

And he can't move it as it's untaxed!

Best thing to do is find out why your clamped etc, not go like a dog with three dicks, ****ing a football, and sort it out!

aint being funny but ive been done 3 times this year 1 no tax 1 no sorn and not sending off a logbook imo they only clamp what they know they can get so somewhere along the line someone has seen you or your mate doing wrong and they have got you. Your fuked to be honest unless you do the said and remove all attachaed bits but they have you on file so your still bolloxed i tried every story in the book when they did me for no tax the mai being as i didnt have insurance docs and my car was taxed 3 days after i was seen!! get the fine paid trust ;)

undo the lower arm/hub/wheel and remove it. All they can do is clamp it again. Dont damage it or you will be in trouble. If its off the road and on private land they shouldnt be there clamping! Would they open your garage up to clamp your car?

Im assuming its untaxed/ not SORN?

It was a company contracted by DVLA I was mistaken. It was them that was not being co-operative. Turned out the Sorn was not on system or somthing and the proof of SORN, was shown and DVLA contacted, the clampers released the clamp.

What would of happened if you just took a grinder to the clamp, put the car in the garage out the way and then just got rid of the clamp where no one could find it ?

Theyd just turn up knocking at your door and they wouldnt have any proof that youd done anything, you could just say the clamp went missing so you put the car away in the garage, and its your car and you can do what you want with it.

All this seems stupid to me, I bough my Golf earlier this year without Tax. I have had no tax renewal letter from the DVLA so how am I supposed to sorn it?

get in touch with them, just cos you didn't get a letter didn't mean they didn't send one. the first thing you may hear about it is when the summons comes thru your door, and its always to a court about 50 miles away so you'll not want to go to answer the charges
