The difference between a cake and a biscuit is - A cake, when left to go stale, will go hard. A biscuit, will go soft.:) i do believe sir that the difference between a biscuit and a cake is that ONE is made from a batter and baked (such as a sponge CAKE)
and the other is made into a dough and cut into circles and put in the oven, which is a biscuit, its all in the preparation baby

Under UK law, no Value Added Tax (VAT) (http://en.wikipedia.org/wiki/VAT) is charged on biscuits and cakes — they are "zero rated". Chocolate covered biscuits, however, are subject to VAT, currently 15%. McVities classed its Jaffa Cakes as cakes, but in 1991, this was challenged by Her Majesty's Customs and Excise (http://en.wikipedia.org/wiki/Her_Majesty%27s_Customs_and_Excise) and the case ended up before the courts.[9] (http://en.wikipedia.org/wiki/Jaffa_Cakes#cite_note-8) This may have been because Jaffa Cakes are about the same size and shape as some types of biscuit. A question that the court asked itself was "what criteria should be used to class something as a cake?"

Contrary to a commonly held belief, whether something is considered a 'luxury item' is not a test for VAT purposes.
